Only way I know around this is using OBS and a stream key from Steam.
In that scenario you would have to start the stream when the game starts and OBS has control of the window.
Steam is a gaming platform for all, which mainly includes young kids/adults.
This is likely done out of protection for that audience so users are not being watched without knowing it.

The route I talk about takes several steps and hoops that can be argued, you knew what you were doing and not being secretly watched without permission which creates an entire different legal issue.
Even with this setup OBS will not show your overlay unless told it can show it in said stream setup. Allowing to check overlay in game and viewers never see it giving a quick way to check chat or other setting privately.

The only reason I said try the change of chat settings is because it lets you relocate the box which used to be attached to the recording icon. This would of at least allowed you to move it out of the way.
I have not used in game broadcast in some time and have taken the OBS route. So any changes since then I have not had to deal with and sounds like since you guys tried it, is no longer attached to the record icon.

I agree they should at least let you move it out of the way onto another location.

So It Does Not Move The Live Icon...
And If I Set It To Off You'd Think It Would Not Show At All...
